Please read these Terms of Service ("Terms") carefully before using the www.techonedge.co.za website (the "Service") operated by EdgeOnTech / TECHONEDGE (PTY) LTD ("us", "we", or "our"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
1. Agreement to Terms
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
2. Services
EdgeOnTech is a specialized web agency that provides high-performance website development services, including but not limited to custom website design and development, website optimization, e-commerce solutions, content management systems, and ongoing website maintenance and support (collectively, the "Services"). All services are subject to a separate service agreement or statement of work which will govern the specific terms of service delivery, project scope, timelines, and deliverables.
3. Quotes and Proposals
All quotes and proposals provided by EdgeOnTech are valid for a period of 30 days from the date of issuance unless otherwise specified. Prices are subject to change based on the final scope of work, project requirements, and additional features requested by the client.
4. Project Timelines
EdgeOnTech provides estimated project timelines for each service package (Starter Site, Business Builder, Custom Build). While we strive to meet these timelines, actual delivery dates may vary based on project complexity, client feedback cycles, content availability, and revision requests. Delays caused by client-side factors (such as late content delivery or extended revision periods) may extend the project timeline beyond the initial estimate.
5. Intellectual Property
Upon full payment of the agreed project fee, the client will own the final website deliverables, including custom design elements and content created specifically for the project. However, EdgeOnTech retains ownership of any proprietary tools, frameworks, code libraries, and development techniques used in the creation of the website. EdgeOnTech reserves the right to showcase completed projects in our portfolio and marketing materials unless otherwise agreed in writing. Third-party assets, plugins, or services integrated into the website remain subject to their respective licenses.
6. Client Responsibilities
Clients are responsible for providing accurate, timely content (text, images, logos, etc.) and feedback during the project. EdgeOnTech is not responsible for delays caused by late or incomplete content delivery. Clients must ensure they have the legal right to use all content provided to EdgeOnTech. Any third-party services or accounts required for the website (such as hosting, domain registration, payment processors, or third-party APIs) are the client's responsibility unless explicitly included in the service agreement.
7. Revisions and Changes
Each service package includes a specified number of revision rounds. Additional revisions beyond the included amount may incur extra fees. Major changes to the project scope after the initial agreement may require a revised quote and extended timeline. EdgeOnTech will notify the client of any such changes before proceeding with additional work.
8. Links To Other Web Sites
Our Service may contain links to third-party web sites or services that are not owned or controlled by EdgeOnTech, such as hosting providers, payment processors, or third-party integrations. EdgeOnTech has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You acknowledge and agree that EdgeOnTech shall not be responsible or liable, directly or indirectly, for any damage or loss caused by or in connection with the use of or reliance on any such third-party services.
9. Limitation Of Liability
In no event shall EdgeOnTech, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.
11. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms of Service on this page and updating the "Last Updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
